David Jones Corporate Services Order Terms and Conditions

1. These Terms & Conditions apply to a business (Customer, you) on whose behalf its personnel place orders for David Jones Gift Cards (Gift Cards) from David Jones Pty Ltd (ABN 75 000 074 573) (David Jones, us, we).

2. You accept these Terms and Conditions each time you or any of your personnel:

1. place an order for Gift Cards via this site;
2. participate in David Jones Corporate Gift Card program, regardless of the manner of participation.

3. By placing orders for Gift Cards via this site, Customer’s personnel warrant that they are authorized by Customer to enter into accept these Terms and Conditions on behalf of Customer and have all necessary authority to enter into and bind Customer to, these Terms & Conditions.

4. Customer and its personnel also warrant that:

1. all information provided by the Customer or its personnel (including as part of the customer registration process) is true, accurate, complete and up to date;
2. the Customer and its personnel will comply with all relevant laws relating to the Customer's placement of any order for Gift Cards via this site.

5. By placing an order for Gift Cards, you acknowledge and agree that such order is an offer by you to purchase Gift Cards for the price notified to you. David Jones is not obliged to accept your order and may accept or reject your order for any reason in our sole discretion, including but not limited to suspected fraud, and breach by you or your personnel of these Terms and Conditions.

6. Each order accepted by David Jones constitutes a separate binding agreement between the Customer and David Jones for the supply of the ordered Gift Cards. If we reject an order we will notify you of that rejection within a reasonable time after submission of the relevant order.

7. All orders of physical David Jones Gift Cards attract a delivery fee and will be delivered to the recipient nominated on your order form. Gift Cards cannot be collected from stores or Corporate Services. Orders cannot be delivered to PO Box addresses.

8. Risk and title in the Gift Cards will pass to the Purchaser upon delivery of the Gift Cards to the Delivery Address, as per the delivery instructions in the Purchase Order.

9. You may be eligible for a discount on your Gift Card order. The amount of the discount (if any) will be determined by David Jones based on our assessment of you having met met the eligibility criteria. We reserve the right to remove or decrease any discount at any time in our sole discretion. We will give you at least [30] days’ notice of any changes to the discount. However, we may remove a discount immediately if we reasonably believe you or your Personnel have breached these Terms and Conditions, including if we believe that the information provided by you and used by us to determine whether to offer you a discount is no longer correct.

10. GST will not apply to the sale of a Gift Card. However GST will apply to additional surcharges such as delivery fees and cancellation fees.

11. Physical Gift Card orders can be paid for by EFT, or third party credit card (Australia only). Digital Gift Cards orders can only be paid for via EFT. Corporate Services will issue a tax invoice to the nominated order contact on the next business day following acceptance by David Jones of your Gift Card order.

12. Order activation is the responsibility of you and/or the nominated recipient. Gift Cards cannot be activated individually. Physical Gift Card orders will not be activated until payment is received. Digital Gift Card orders will not be delivered until payment has been received. Cancelled orders may attract a fee. Digital Gift Card orders cannot be cancelled once activated, or the full value will be forfeited.

13. The information that you provide on your order form is handled by David Jones according to its Privacy Policy which can be found at www.davidjones.com/information/privacy-and-security. By accepting the Order Terms and Conditions, you confirm your acceptance of the David Jones Gift Card Terms and Conditions which can be found at www.davidjones.com/giftcardtermsandconditions. By placing an order for David Jones Gift Cards, you consent to receiving marketing communications from David Jones Corporate Services. If you do not wish to receive marketing material from David Jones Corporate Services, please email corporate.services@davidjones.com.au or call 1300 301 906.

14. Subject to clause 15 neither David Jones nor its affiliates, directors, officers, employees, agents, or contractors, are liable for any damages, losses, liabilities, expenses or claims whatsoever, whether in contract, tort (including negligence), statute or otherwise, arising out of, or in connection with the supply of Gift Cards or these Terms and Conditions.

15. David Jones’ liability for a breach of any condition or warranty that cannot be excluded is limited, at David Jones’ option to:

1. Supplying the Gift Cards or services again;
2. the cost of having the services supplied again.

16. Notwithstanding clause 15, if a Gift Card is faulty or does not meet a Consumer Guarantee under the Australian Consumer Law, David Jones will refund the amount paid.

17. David Jones reserves the right to make amendments and variations to these Terms and Conditions, at any time. We will notify you of any variations by publishing an updated copy of these Terms and Conditions on this site.
